Cancelling a membership at the gym with Virgin

Hi Guys,

I'm moving away in 3 weeks time, but I am tied in to a 12 month contract with Virgin which has about 7 months remaining.

I'm going back down to my mums in Norwich, and a quick search shows that there is no Virgin Active for over 50 miles.

Am I eligible to cancel with them?

Some gym's have a claus that if you are moving out the area you have the right to cancel, or even pass on the membership to another person... hopefully it works this way for you :)

Why not just cancel the direct debit? They can't go into your bank and take money.

I had this with LA Fitness...i had to pay the remaining amount of months on the contract.

I'm not sure cancelling a dd is the right way to go about it as they may call in debt collectors and get you blacklisted and then future finance, i.e. loans and mortgages would be a no go.

i did that and they restarted it without my permission. went for 3 months without realising

No way! i didnt think that would legal for them to do?

OP, is your move permanent? If not I think you can put your membership on hold temporarily for up to 12months if that would be an option?

they said it was their new computer system activated it automaticly. they couldnt refund it straight away either.

if you move away and there is no Virgin gym within a reasonable travelling distance then its technically a frustration of the contract as they can't provide the service you are paying for.

They may try and fob you off but if it ever went to court and it wouldnt because they would lose then you simply say that you wanted to train at a Virgin gym but they didnt provide one near to where you move and you cant be expected to put your life on hold because of a gym membership which you cannot use because it is so far away.

Its different if you simply want to move gyms as teh gym can fulfill its part of the contract and provide the service.

Also collection firms can't blacklist you, they have to go to court for this and get an injunction.

All they can do is pass it on to a collection agency - who can't send out collectors for this type of debt. They are hardly likely to get a CCJ against you for the sums involved, and as Tom says they'd lose in court anyway. Personally I'd send one letter saying I'm moving and end the DD. Any collection calls I'd simply refuse to give personal info over the phone - which means they can't speak to you - in previous financial crisis I've taken great pleasure in doing this!

No you need to write an official letter to the manager stating your reasons and teh dates which you will be leaving.

You need to be as accomodating as possible and therefore I would give them as much notice as possible, at least a month.

I would also state that you are happy for your membership to be suspended until you move back to an area where there is a Virgin Gym so you can continue your membership when you are able

basically you need to show that you really want to keep your membership its just that situations dont allwo you to.

Therefore when they write back saying 'tough you have to pay' you can respond by highlighting how unreasonable they are being and if it goes to court you can show that you did everything your end to be helpful and accomodating and they were unreasonable towards you.

Basically give them all the options you can that involve you NOT paying but keeping your membership open, then at the end give them an option to cancel the membership because they cant provide the service.

They will most likely write back first of all saying you will have to pay. Thats when you write back stating that its a frustration of the contract and if they can't provide the service you are paying for then thats not your fault and you are not liable. Plus state that the remaining membership is worth about £30x7 months? £210 and thats not worth them pursuing especially through court where they might lose and you can claim damages or costs for unreasonable behaviour after you have been so reasonable and accomodating.

Just some ideas for you.

Just thought, they will probably ask for proof of your move so get this before writing the letter as it will help you greatly.

I have cancelled and changed as I pleased with virgin and have never paid a re-join fee.

Bank>Cancel DD>Done
