Rental agreements

Hi,

last jan 2007 I signed a 12 month tenancy agreement for a room. This would have expired in jan 2008, but i've been staying in the house until now (jul 2008). I now want to leave. I have gotten behind in some payments and lost my job. Can I just go. I don't care about losing my deposit as its less than the rent I owe. I didnt intend this to happen but I have encountered financial difficulties and I'm very stressed about the situation. Am I legally bound to pay or can I leave?

Appreciate any advice.

I don't know about the law, but if you leave having owed rent. That's theft in my book.

It depends on what your lease says.

for example your lease must say something about about a noitce to levae for both parties.

so you have to give a notice, and pay the total amount, if you do not, you landloard can register this is with a credit agency and this will affect you credit in the future.

The best thing to do is speak to the landlord and explain your problem, if hes ok, you will both sort something out.

if hes not already being harsh on you for being late with the rent you should be able to sort something out.

Better to confront the land lord,
he will probably appreciate your honesty,
you might end up on the default register,which will stop you getting credit or buying property in the future

You probably signed a 12 month Assured Tenancy Agreement, which ended in January. The tenancy then rolls over into a monthly contract until (usually) one month's notice is given by either side.

You have several options:

Give one month's notice, pay it up and make arrangements to pay any outstanding arrears over a re-payment term acceptable to both you and the landlord (this could be over several months).

Give the notice, same as above but then default - risking being pursued for a civil debt through the small claims courts.

Give no notice, do a bunk and ditto above regards the debt.

Whether th landlord chooses to pursue you for the money will depend on how much you owe, whether he can track you down or not and generally the way he and you got along through the tenancy. Clearly the "right" thing to do is option one which I have set out for you.

you will lose your deposit and have to make arragements to pay what you owe in rent arrears otherwise the landlord will take you to court..
then you will have a CCJ on your credit file buggers your credit up...

Best confront landlord and make suitable arrangements,,chances are they are reasonable and will understand the cicrumstances at the end of the day they will appreciate the fact that your offering to pay up and not just doing a runner owing money

Yes you're legally bound to pay. You've been using his house - you owe him money.

If you don't pay, he will most likely file a claim against you in small claims court, which will result in a CCJ if you still don't / can't pay after that. CCJ's are usually bad as it means you can't get credit (think cards, cars, even monthly mobiles...anything with credit).

If I were you I'd talk to him straight, and agree some form of smaller, longer re-payment scheme, or else borrow it from someone who trusts you, and pay them back when you get a job.
