My Gym and I are having a problem

My gym in Potters Bar, hertfordshire and was called Sportz Academy when I first joined. I signed up a 12 month contract with them and have been paying every month by direct debit. I saw out the contract and my payments were still being made by me as I was still using there gym.


Then Sportz Academy sold out to a new company called Parkwood and took over the gym. I was still using the gym and paying monthly and no new contract was produced and signed by me when the change happend.

Then between March to October 2007 last year I cancelled my membership because I moved abroad. I came back to the Uk and decided to come back to start using the gym again. They just re-activated my account and I made monthly payments ever since.


Yesterday I didnt have my membership card with me to gain access into the gym. So the lady behind the desk said "Whats your name?", I said "Oliver Brown" and then she said "Sorry, I cant allow you in because you have arrears of £300". I then said "How is this possible, theres some mistake?" She then said "you owe us payments between March and October 2007". I then said to her " Theres definatly some mistake because, I cancelled my membership".

She wouldnt let me in and I stormed out the gym, drove to the WORKS gym pay as you go. I wrote to my gym and sent it in the post yesterday and waiting for there reply. I stated in the letter that im refusing to use your gym until this is resolved. From today I only owe them for this month because I havent cancelled my membership.



What are you opinions on this?

How did you cancel your membership? was it over the phone face to face, did you get a letter from them to say it had been cancelled, like a sorry to see you leaving letter?

did you read the small print... i know gyms that do what phone companies do, if you sign a 12 month contract and you want out you have to pay your way out of the contract...or similar....same may apply to that gym...

Have you any paper work or a copy on the orginal contract you signed to look at???

The only contract i had was a 12month one from Sportz Academy and I saw out that one. All paid for.

Parkwood aint given me one. So theres no agreement

right... sort of like BT... ive only ever signed one contract 3 years ago for my broadband the rest of the time they ring me up and say are you happy with the service and to continue... maybe they do it in a similar way!... but without contacting you

seems like a bit of a fook up to me... they should get back to you when they get your letter!

At the end of your 12 months contract with SA you were deemed to be in contract with Parkwood as you were still using the gym so standard or implied contract terms would be in place.

If you provided adequate notice to Parkwood in writing and you still have a copy of that (hint....) then you can produce that as proof the contract was terminated.

You should have been given notice that the gym had been taken over as that would have been an amendment to your terms and conditions.

Upon account re-activation any issues should have been highlighted then (when did you re-activate?) and further they should have chased you for the owed money in April/May....

Ask leeston, but I'd say you have a fairly good case.

Unfortunatly i dont have the orignal contract as that was 3 years ago and has now finished.

the gym did give me a letter when they took over but there was no terms and conditions mentioned. Just saying new managment in place bla bla bla.....etc.

They havent chased me for Money. They still have a address where a tenant of mine lives, so all the **** goes there.

unfortunatly i dont have the contract Sportz academy gave me. I got rid of it as i saw it out you see. Shame wish i had it now. :(

ok write a letter saying i am cancelling my membership back date it to the time of when you actually cancelled it take it into the gym or send it to the HQ and threaten to take them to court if they dont stop pestering you for money you dont owe..then delete this thread in case they are uk-muscle addicts like the rest of us :lift:
