Its not on you to prove you cancelled the contract its on them to prove they have one. When I left there they gave me sh1t too mate, I was there for like 3 years, when I left they said that I had another 3 months on a contract, so I told them to show me. they pulled out their terms and conditions which were new. I laughed and said thats not what I signed and they told me that I did.... When I asked for a copy of the document I signed to the new T & C's which legally I can have a copy of they left it there. Trying it on mate. Go down and talk to the manager, fook the bird on the front desk - just jump over and go to the office's. Does Fran still work there? I can have a word with her if she is?

I went to the works yesterday and had a good workout and im considering using that full time. No messing about in that gym mate. I dont know any of the backroom staff just the gym team.

I did something similar a few years ago when I left the ex & had a few issues with the gym. |

![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() ![]() | Re: My Gym and I are having a problem i hate this kind of BS certain types of gym seem to try and pull. david lloyds has been ****ing me off especially since they keep sending new terms and conditions,with the original contract i signed after 6 months of membership with them,you could use ANY david lloyds in the country!this obviously has massive appeal.now they've changed the terms and conditions so you can only use the club that you originally registered with and if you want to use another club you have to pay 12+ pounds.if it was something reasonable like 5 pounds i wouldn't mind so much,but i'm not going to pay 12 pounds for one training session,i can just as easily hit a different gym for 6 pounds even when i'm not a member there! if they didn't send you new terms and conditions different to your original contract,i can't see how they can legally ask you to pay when you cancelled your membership for a period.but like others have say you tend to need something in writing these days for it to make any difference. what is the world coming to? sigh. rant over ![]()

Even though the contract was for 12 months, that was almost certainly a minimum and the wording of the terms probably means that the contract is continuous (i.e. open-ended) until either party serves notice. It is highly likely that that notice would have to be one month in writing, unless the other party accepts notice in alternative forms. The fact that you continued to pay them after the 12 months would be taken by the courts as proof that you both intended the contract to continue (the fact that the company was taken over matters not). However, as you cancelled the DD that would be taken as evidence on your side that you intended the contract to be ended - and the very fact that you failed to pay is a breach of contract. Technically you could be sued for this, but the company has suffered no loss as you did not attempt to use the gym when you weren't paying. All of which comes to: tell the bint at the front desk to sod off.

![]() ![]() ![]() ![]() ![]() ![]() | Re: My Gym and I are having a problem ask to speak to the manager mate. they always have powers they can use at their discretion to wipe off this kind of 'debt'. explain that under no circumstances will u be willing to pay this money as u were not a member of the gym for the period stated. also state that you are happy at the gym and wish to continue training there and paying your monthly membership to them, but will be looking for another gym if they cannot resolve this matter to your satisfaction. one more thing - do not give them ur address. they do not need it unless they are chasing you for money. bastards! |
