End of gym membership - gym getting heated with me

Hi Guys,

Anyone with knowledge of cancelling gym membership?

I was a member of a large national gym which I recently left. I paid annually and was there for two years. Unbeknown to me I was expected to give three months notice before leaving.

I had forgot about the notice requirement and after my second year I simply did not return.

However, two months down the line the gym are getting heavy saying that I have breached my contract. I accept that this is true but wondered if any of the members, PT's or gym managers on here are aware of this type of action and how far they pursue it?

So far I have resisted but would like some clarification. I have returned my threat and advised that in the event they proceed with an action for breach of contract I will draft a suitable defense upon which I will seek to rely and include a claim for costs for both the wasted of both mine and the court's time in this action. Thats me being amicable.

If its in the contract that you've signed, you are fcuked. They will be dealing with hundreds of cases like yours and are probably very good at collecting their loot.

Pay em' up, learn a lesson and move on.

When you took out you gym membership can you remember if they covered what to do if you wished to cancel the contract?

Also you said that you had been a member for over 2 years is this correct, if so did you just continue with your initial contract membership with the gym or did you resign another contract?

And lastly like some1 else asked what gym was it???

If you can answer these three questions i might be able to get you out of it!

hi chris,

the gym was David Lloyd.

To the best of my knowledge they did not explain to me the cancellation procedure during my initial walk around. However, they will seek to rely on the wording in the policy booklet which they did give me.

I was a member for two years and it was a continous contract. I did sign a document to confirm the single direct debit at the start of each year.

Upon reading your post again i have just read that you paid annual as in a years membership in 1 is this correct?

As if this is correct then you are not required to give any notice as long as you have paid your membership for that year, the 3 month clause usually comes down to when you are paying monthly via DD and then its usually either 1 month or 3 months but this is only justifiable due to the gym having to do its admin work as they call it, which basically is canceling your membership, and then also canceling your DD with the bank so they don't take any more money (apart from the 1 or 3 months that you have to stay a member)

chris thats interesting. I did pay yearly (ie one payment straight off and not monthly) and whilst technically I do not owe them any money and have not used their club since the end of the second year's membership. I feel it is wrong what they are doing.

Yes, you could argue I have breached the contract but come on, I signed the initial contract two years ago and who is going to remember the precise wording. In my opinion I do not owe them anything.

Usually the contract that you take out with a gym or anything else for that matter is a rolling contract after the first month,quater,or in gym cases year. Therefore because you signed up and completed not only your first year but also your second year aswell i would firstly call the gym and ask to speak to the gym manager or sales manager, i would then put it to them that you have completed your minimum requirement of your contract and even stayed for another year aswell!

Ask them to justify firstly why you are subject to giving them 3 months notice when you have finished your minimum contract and secondly ask them why you are subject to three months instead of the usual 1 month for rolling contracts!

See if it was in your first inital year then they can justify that you have to give them 3 months as when you join most gyms your subject to a 12 month contract the same as mobile phones, internet, cable tv etc. So if you want to leave in that time they can say how much you have to pay or how much notice you have to give, HOWEVER after that first yr of that contract as you know you only ever have to give 1 months notice if any before terminating your agreement/contract!

You may find however that you will be required to pay an additional months membership, but only if the gym is being total D**ks

Then if you dont even want to pay that it usually works if you say "ok i will pay it but after i do i will make sure every member knows how you look after or dont look after in your case your customers and most importantly future customers as i will be going to the (here you can say anything like papers, tv etc) and telling them how you rip off your members when they are leaving" here you might get told for a while by the gym manager that you cant as that will be slandering the company and all's you have to do is reply no its not as you are not saying anything that is not true, where as slander is when you make something up to make something/someone look bad here you will just be telling the truth about what happened to a loyal gym member lol its playing the system as no one wants bad publicity

It works everytime lol

Depends on the gym i think.....I had a 12 month contract at Living Well which i cancelled my DD for well before it was up....All i received was a letter saying i was due them 80 buks....I binned it and never heard anything else...

Living Well was then taken over by Bannatynes which i joined a year later, now im trying to get out of my contract there because i've moved address....I've only got a few months left so i'm just going to cancell my DD, if they chase me i'll pay otherwise fck them!!!

Next Gen do this

If you argue the toss they will do a months cancellation.

But if you paid yearly then just tell them bollox. You've paid for the year so there's no reason why you need to pay anything else.

If it goes to court which is doubtful you'll be able to argue this.

i was with david llyod and wanted to leave so they told me about the 3 month period... i went home and cancelled the direct debit.

one month later i recieved a letter stating the 3 month period blah blah, i owe them X amount.... etc etc

i ignored it

i then recieved a letter from a debt collecting company requesting the money.

in short they got their money to the value of 3 months gym fees
