![]() ![]() ![]() ![]() | Dodgy Cash Machine Right, i tried to withdraw £300 pounds from my account last week using a machine not of my bank, the machine did not dispense the money but still debited my account. So i went into my branch the next day and filled out an ATM dispute form and they contact the bank of which the cash machine belongs. Im not rich and £300 is alot of money at the moment to go without for up to 4 weeks they say. I just wondered if anyone else has been in this situation and if they did get there money back eventually? Im just worried it may go on for a while until they give it me back. Also cant i get some sort of compensation? |

Hi mate, I have never heard of this happening but can imagin it is common when the ATMs run out of money or are defective. I cant help you much except to say that in order to pay compensation the bank need to be found negligent. On the basis that the machines are checked consitently throughout the day then it could be argued that they have done what is reasonably necersarry. If it breaks down outside of normal working hours and they are not informed of it until the following day (or in the morning when they open up) then it may be difficult to prove negligence against them. If it had been defective for over 24 hours then that is a different matter. If the bank isa third party bank and not one who you hold the account with then I doubt they will offer you any ex-gratia or 'we are sorry payment'. If it was the bank which you hold the account with then you may have grounds for a complaint and they may look exceptionally upon you, it is up to them.

| Its a Natural Tan :P | Re: Dodgy Cash Machine lol this happened with me a few years ago, but was only a 10er, i went into the bank and told them, they said they could do owt and i needed to go to my bank, i walked by the bank 20mins later and the ATM was 'out of order' lol. anyhow it was a tenner and i couldnt be ****d chasing it up. I also had my card Cloned at a atm machine, and lost 500 quid, but i got that back after 2 months, that was a fruad case, so a bit different/
